User Agreement

Medical Monitoring Terms and Conditions Agreement

The term (security) in this document will be used to identify the service of all Personal Emergency Response Systems and their components and services to the client. This document applies to the type of service or services this client has chosen from “Family First Alert LLC”. Please scroll to the bottom of the page to sign.

Client Declaration and Agreement:

As a customer of “Family First Alert LLC”, I hereby declare that I received a security monitoring system that was in good working order at the time of delivery, that I witnessed that it was tested successfully, and that I was satisfied with its operation and its service, and its installation. I further make it known that I understand fully that this service is only meant to help deter security problems of any kind and that this service from “Family First Alert LLC” is not in any way making any type of claims that this system or service will be effective at any point in time in any manner be it safety, security or to the health of anyone.  I fully understand that electrical issues, and phone service malfunctions, including cellular signals and system malfunctions, can occur at any time and that I or anyone affiliated with my family will not hold “Family First Alert LLC” responsible in any way for system failures do to, but not limited to, faulty installation or negligence. By agreeing and purchasing this security service from “Family First Alert LLC”, I don’t expect this service to be without problems at any given time and will assume all liability issues and will not in any way hold “Family First Alert LLC” responsible or liable.  I understand that this service is one of many choices that I can agree to use to help in the security of my premises and that it is only meant to be of limited help when all the equipment is functioning properly and that if the equipment for ANY reason fails to operate at any time, I am willing to accept that risk for myself and my family and anyone else that is living at my premise or visiting my premise.  I make it known that I was in no way pressured to purchase this service from “Family First Alert LLC” and that by doing so, it was of my own free will and desire to assist in the protection and security of my premises. 

Security Limitations:

FAMILY FIRST ALERT LLC DOES NOT REPRESENT THAT ITS PRODUCTS MAY NOT BE COMPROMISED OR CIRCUMVENTED; THAT THE PRODUCT WILL PREVENT ANY PERSONAL INJURY OR PROPERTY LOSS BY BURGLARY, ROBBERY, FIRE, OR OTHERWISE; OR THAT THE PRODUCT WILL IN ALL CASES PROVIDE ADEQUATE WARNING OR PROTECTION.  BUYER UNDERSTANDS THAT A PROPERLY INSTALLED AND MAINTAINED ALARM MAY ONLY REDUCE THE RISK OF A BURGLARY, ROBBERY, OR FIRE WITHOUT WARNING, BUT IS NOT INSURANCE OR A GUARANTEE THAT SUCH WILL NOT OCCUR OR THAT THERE WILL BE NO PERSONAL INJURY OR PROPERTY LOSS AS A RESULT.  CONSEQUENTLY, FAMILY FIRST ALERT LLC SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS BASED ON A CLAIM THAT THE PRODUCT FAILED TO GIVE A WARNING.  HOWEVER, IF FAMILY FIRST ALERT LLC IS HELD LIABLE, WHETHER DIRECTLY OR INDIRECTLY, FOR ANY LOSS OR DAMAGE ARISING UNDER THIS SALES ORDER OR OTHERWISE, REGARDLESS OF CAUSE OR ORIGIN, FAMILY FIRST ALERT LLC ‘S MAXIMUM LIABILITY SHALL NOT, IN ANY CASE, EXCEED THE PURCHASE PRICE OF THE PRODUCT PART THAT FAILED, WHICH SHALL BE FIXED AS LIQUIDATED DAMAGES AND NOT AS A PENALTY, AND SHALL BE THE COMPLETE AND EXCLUSIVE REMEDY AGAINST FAMILY FIRST ALERT LLC. THIS WOULD ONLY INCLUDE THAT SPECIFIC PART OF THE SYSTEM AS A WHOLE AND NOT THE ENTIRE SYSTEM.

Monitoring:

I understand and accept that “Family First Alert LLC” will be contracting with outside companies which will be doing the monitoring part of my service and agree that I cannot and will not at any point during this service or after this service with “Family First Alert llc”, try in any way, to hold “Family First Alert LLC”, or its employees, or associates, responsible for any problems which may or may not occur, due to the actions or inactions of the actual monitoring company that was assigned to monitor my system. I further understand that the “Family First Alert LLC” service is in no way meant to be a medical service or a life-saving service of any kind.  I understand that this service may help in some way to save my life, or a family member's life, but it in no way claims to be responsible for doing so if a medical problem were to arise.  I also will not hold “Family First Alert LLC” or any of its employees or associates responsible for making such a claim. I fully agree that when I take this service, I am doing so at my own risk and will not hold “Family First Alert LLC” or any of its associates responsible in any way.  

Periodic Testing of equipment:

I understand that it is my sole responsibility to test my system regularly (at least twice per month) for its communication effectiveness and that if it in any way becomes in a non-communicative state with the monitoring companies, it is my responsibility to make this status known to “Family First Alert LLC”.  I understand that if I do not make this knowledge known to “Family First Alert LLC,” I will not in any way hold “Family First Alert LLC” responsible for not providing me, or my family member, with another working unit or service.  I understand that I must allow “Family First Alert LLC” a reasonable length of time to see that I am back online and in full service with the monitoring company, and that this repair may take up to 1 week or more to complete. I further understand that if any part of my system needs to be replaced and the mail service is used to send me to another working unit, I may be without service for as much as 3 weeks if that mail system is slow.  I understand and will not hold “Family First Alert LLC” responsible in any way for the speed of whichever mail service is used to send me another device. If my system requires batteries, I am responsible for maintaining the system with working batteries on all devices.

Interruption of Service:

I understand that “Family First Alert llc” assumes no liability for interruption of monitoring service due to strikes, riots, floods, storms, earthquakes, fires, power failures, insurrection, or unavailability of telephone service, cell service, acts of God, or for any other cause beyond the control of “Family First Alert LLC”, that “Family First Alert LLC” will not be required to supply monitoring service to me or my family member, while any such situation or condition may continue. I understand that if my device for monitoring uses a cell signal to communicate with the central station, and if the cellular signal is lost, my system will not be able to communicate with the central station, and I will not get help.  I further understand that this situation is possible, and I am willing to take that chance and will not hold Family First Alert LLC or the central station being used responsible in any way.  I understand that I am using this service at my own risk.

Cellular System

AS A CLIENT USING The  Cellular System,  I understand that by using this type of system, I can go anywhere where there is sufficient cell service for this type of unit and that I will be responsible for maintaining a full battery charge on the unit, which may require me to charge it daily.  I understand that if I go outside the range of the button’s communication capabilities, it will not work.  I am using this device with no expectations of complete coverage, and I use it at my own risk.  I understand that the charger that goes with my system is to be used to charge it and that I am responsible for using it when necessary.  I understand that by not doing so, my system may lose power and will not work when I need it.  I understand that I or my estate is responsible for the return of the equipment to Family First Alert LLC within 1 week of my canceling the service or in the event of my death and that if it’s not returned by the next billing date, I or my estate will be charged the fee of $350.00 for the replacement cost.  I further understand that if Family First Alert LLC deems there to be any damage due to client error or mistreatment of the equipment, I, or my estate, will be responsible for the full replacement cost of the equipment.  I understand that when turning in the equipment, I must include all accessories that came with my equipment, including the button, the charger and the necklace, and belt clip, and ALL boxes and brochures.  

As a user of the Cellular System, I understand that this type of system is subject to limitations to cell tower connectivity and that if I choose to put myself in an area physically where the system cannot get a cell signal to report a problem, the sole responsibility of that failure rests with me as the client and not that of Family First Alert LLC.  I fully understand that there are areas where the Cellular System does not work, due to the inability to acquire a proper signal.  I’ve been made fully aware of this situation and agree to the service under these circumstances, by my own choosing.

I understand that I am responsible for safeguarding the components of my system from electrical storms by using appropriate plug-in devices with circuit breaker protection. I further understand that if the circuit breaker device that I choose for protection fails, I am responsible for the cost of the replacement of the monitoring equipment. I understand that the decision rests solely on the part of “Family First Alert LLC” to decide whether I or my family member is liable for any damage to the monitoring device. I understand that if I’m using the cellular system, I am responsible for making sure all the electrical ports on my button are securely closed when taking a shower so as not to damage the unit with water.  I understand that if I fail to do so, I will be responsible for the replacement of damaged equipment. I also agree to return the system in the box provided at startup with all the brochures that came with it.  Failing to do so will result in my being required to pay a replacement fee for said items, $20.00.

Alert Button Pendant If Being Used: 

I understand that if my pendant needs to be replaced due to lack of battery power, I will need to purchase a new one at the then-current cost. I further understand that if the pendant needs to be replaced before the 1st year of service, “Family First Alert LLC” will cover the cost of the pendant. I understand and make it known that I must test my pendant frequently to make sure that it is communicating, and that if my pendant fails to communicate, I must contact “Family First Alert LLC” immediately to make an appointment for them to service it.  I understand that if my pendant fails, I will not in any way attempt to hold “Family First Alert LLC” responsible or liable for its failure.

Paying My Bill Via Credit Card or Debit Card:

I understand that my monthly fee will be taken from either my debit card or a credit card that I willingly provided to Family First Alert to run each month for my services.  I give Family First Alert LLC the right to run my card on a regular monthly basis for as long as I have my service.  I also give Family First Alert the authorization to run said card until they receive the monitoring equipment back that was loaned to me for my services.  This stipulation would not apply to Security Systems that were purchased from our right that the client owns.  I understand that if I’m going to stop services with Family First Alert LLC, I need to give them enough notice time to receive the equipment back from me, unless otherwise something different is agreed upon by both parties.  Family First Alert LLC will give a grace period of ten days for the equipment to return without charging for services for another month.  I also agree to not initiate any chargebacks against any charges Family First Alert LLC applies to my card account, and that I will contact Family First Alert LLC to work out any concerns regarding a refund.  I also understand that this is at the discretion of Family First Alert LLC and that I will agree to their final decision on all transactions and disputes during and after our services are rendered.

Cellular Sunset dates

I understand that cellular companies occasionally enforce a “Sunset date” where they stop using their services for certain plans, such as their 3G, 4G, and 5G systems.  This is common in the cellular industry when they upgrade.  When this occurs, I understand that if my system works on the type of system that is being discontinued, my service will no longer be active and working until I have upgraded my equipment to the new system.  I further understand that upgrading will cost me another startup fee to continue the service.           Family First Alert LLC Medical Monitoring & Terms and Conditions Agreement

Initial Fees and Payments, and Refunds: 

I understand that by making a payment to “Family First Alert LLC,” I am agreeing to the service they provide for the period my payment is for. I understand that there is a late payment fee of $5.00 due if my payment is not received by the 10th of each month. I further understand that my service may be terminated if payment is not made. I further understand that there may be a reconnection fee to reconnect my service. I further understand that “Family First Alert LLC” will not make any financial refunds once paid, and I will not in any way try to hold them responsible to do so. I further understand and agree to make my estate responsible for all outstanding fees, including any charges past or present, in the event of my death.

 

Health Information:

I understand that “Family First Alert LLC” will provide the monitoring company with a list of special health conditions that I or a family member that I am representing has.  I hereby give “Family First Alert LLC” and the monitoring company the right to know and use this information for my monitoring service, and in no way will I hold either company responsible in any way for this information and how it is used or not used.  I further understand that I cannot hold either company responsible for the knowledge of any health condition or medication I have not shared, or a family member I am representing with “Family First Alert LLC”.  I understand that if my health condition or a family member that I am representing changes, I am responsible for contacting “Family First Alert LLC” to make that information known to them.  I understand that I must allow one week for any changes in my health information to be recorded with “Family First Alert LLC” and the monitoring company. I will not hold “Family First Alert LLC” or any of its associates, workers, or affiliates responsible for the failure of provide the correct client information by the monitoring company, 911 affiliates, health care providers on ambulances, or in any health-related institution associated with the client or the person using this service.  I make it known that the information, both personal and health-wise that I, or the client that I am providing services for, submitted, was correct to the best of my knowledge and was recorded correctly by “Family First Alert LLC

  By signing my signature to this document, I am stating that I understand and agree to the terms within this document and will not hold “Family First Alert LLC” liable in any way for the services rendered to myself or my family member. I hereby agree to indemnify, defend, and hold harmless “Family First Alert LLC” and its directors, officers, employees, agents, and affiliates from and against all claims, damages, liabilities, costs, and expenses, including legal fees and expenses arising out of or relating to all services that “Family First Alert LLC” has provided or indirectly provided or been affiliated with. I also waive my right to a jury trial and understand that I will not bring suit for any reason against Family First Alert LLC.

Understanding of this document:

I have read this entire document and understand it fully and agree to the terms therein by signing my name. It has been made known to me by the “Family First Alert LLC” representative either by phone or in person, that if I did not understand any part of this document or that I couldn’t see well enough to read it, this representative would read it to me with a witness of my choice being present and answer any questions that I had before signing this document.   I understand that I can allow my legal representative to look over this document and advise me before I sign it.  I understand that by signing this document, I, or a family member whom I am arranging service for, am bound to this agreement and will not seek, by legal means or any other, any damages at any time, from “Family First Alert LLC” or any of its associates. I understand that I am entitled to a copy of this document if I desire it by requesting it in writing to “Family First Alert LLC” and that I authorize the “Family First Alert LLC” representative to act as a witness to my signing of this document and my agreeing to its terms.  I understand that if I request a copy of this document that it may take up to one month to acquire it.  I understand that I can request that a copy of this document be sent to me by either U.S. Mail or email service. I understand and make it known that I understand by signing this document I am agreeing to the entire multiple-page document and forfeit my right to any legal action against “Family First Alert LLC”, its monitoring companies, or any of its associates or business partners for any reason and that my initials or signature on each page, testifies that I understood all of the languages on that page and agree to this document as a whole and complete statement.  I further agree that if I desire to bring any lawsuit against anyone associated with “Family First Alert LLC”, I will only seek damages of any kind to be no higher than the cost of that particular part of the Security System and not the entire system and that if I am using a personal emergency system, I will only seek damages for one month of service and agree that I will be responsible for any legal fees incurred by “Family First Alert LLC” and its defense of said action.  

I understand and agree to the terms of this document by placing my signature on these pages. 

I sign these documents voluntarily and with a clear and willing mind, under no duress. I understand that if I’m signing this document for a family member or friend, I’m taking all responsibility of this service upon myself to that individual I’m signing for and that I’ve been given permission to sign this document on their behalf by them and that I have read this document to them and they understand it fully and agree to it and my signing of it for them.
